1. About these terms
These terms govern your use of clickorganic.com.au and any services provided by Click Organic (ABN [insert ABN]). By using this website or engaging our services, you agree to them.
2. Our services
We provide search engine optimisation services. The specific scope of work, deliverables, fees and duration for any engagement are set out in a separate proposal or service agreement, which takes precedence over these terms where they conflict.
3. No guarantee of rankings
Search engines control their own ranking algorithms and change them without notice. We do not control search engine behaviour and cannot guarantee any particular ranking position, traffic volume, enquiry volume or revenue outcome. We commit to performing our services with reasonable care and skill using accepted industry practices.
4. Client responsibilities
To deliver our services we require timely access to your website, hosting, analytics and other relevant accounts, and reasonably prompt feedback and approvals. Delays in providing access, approvals or content may affect timelines and results, and do not entitle you to a refund.
5. Fees and payment
Fees are set out in your proposal or service agreement and are payable monthly in advance unless agreed otherwise. Invoices are due within [insert] days. We may pause work on overdue accounts.
6. Term and cancellation
Engagements run month to month unless otherwise agreed. Either party may end the engagement by giving [insert] days written notice. Fees for work already performed remain payable.
7. Ownership
On full payment, you own the content, pages and assets we create specifically for you. We retain ownership of our own methodologies, templates, tools and processes. You retain ownership of all your accounts and data.
8. Third-party services
Our services may involve third-party platforms and tools. We are not responsible for changes to, outages of, or decisions made by those third parties, including any action taken by a search engine against your website.
9. Confidentiality
Each party agrees to keep the other party confidential business information private and to use it only for the purposes of the engagement.
10. Liability
To the maximum extent permitted by law, our total liability arising from the services is limited to the fees paid by you in the three months preceding the claim. We are not liable for indirect or consequential loss, including loss of profits, revenue or data. Nothing in these terms excludes rights you have under the Australian Consumer Law.
11. Website use
